EB-2 National Interest Waiver
This route is still open, but it has become materially harder since 15 January 2025, when USCIS issued its most detailed NIW policy update in nearly a decade (Policy Manual Vol. 6, Pt. F, Ch. 5, effective immediately and applied to petitions pending on that date). The three-prong Matter of Dhanasar test itself is unchanged. The guidance, though, sharply tightens how officers assess the link between a person's profession and the proposed endeavour, and it now demands independent, objective corroboration rather than expert letters and business plans alone. Entrepreneurs must show national-level importance, not just local or personal commercial importance. The language used in requests for evidence has visibly shifted as a result.
NIW is the cheapest self-petitioned green card, and it is heavily oversold to founders and researchers. Since January 2025, a vague, letter-driven petition gets denied. A well-evidenced one still approves at high rates. For Indian-born applicants, the category is now effectively closed by retrogression regardless of merit. That is exactly why the EB-5 rural set-aside is priced the way it is.

- EB-2 India was UNAVAILABLE in the July 2026 Visa Bulletin. An approved NIW is not a green card if there is no visa number.
- The January 2025 guidance treats unsupported expert letters and speculative business plans as near-worthless. Petition mills are still selling a 2019 product.
- USCIS now scrutinises whether the proposed endeavour actually aligns with the underlying profession. A career pivot is a live ground for denial.
- National importance does not mean important to your customers. Local or purely commercial benefit fails the first prong.
